NJ’s Lead-Safe Certification Law
New Jersey has a new law for rental properties relating to lead paint specifically to properties built before 1978. This law went into effect on July 22, 2022, stating all homes must be inspected for lead paint. The process for checking for the presence of lead depends on what city the property is in.

What Property Owners Need To Know
Name: This law is called the Lead Safe Certification Act.
Homes Affected: It applies to rental homes built before 1978.
Inspections: Homes must be checked for lead paint when a new tenant moves in or by July 22, 2024.
Landlords: Landlords must give tenants a copy of the lead-safe inspection results and include it in the lease.
Inspection Period: Inspections are good for two years.
Re-Inspections: Homes need to be checked again every three years, or if a new tenant moves in before then.
Exemptions: Some homes built after 1978 and larger apartment buildings might not need to be inspected. You can find more information about exemptions here.
What Towns Need To Know
Compliance: It is the municipalities responsiblity to track proprety owner compliance for rental units which are not exempt. The DCA states “Municipalities must maintain a record of all dwellings subject to this Chapter which shall include up-to-date information on inspection schedules, inspection results, and tenant turnover.”
